General Terms and Conditions for the Hotel Industry

1. Scope of Application
The General Terms and Conditions for the Hotel Industry (AGBH 2006), as amended from time to time, shall apply to the accommodation contract unless otherwise provided for in these General Terms and Conditions.
These General Terms and Conditions apply to all contracts concerning the temporary rental of hotel rooms, studios and apartments for accommodation purposes, as well as to all additional services provided by the hotel in this connection.
By making a booking, the guest acknowledges and accepts these General Terms and Conditions.

2. Conclusion of Contract
The accommodation contract is concluded as soon as a room, studio or apartment has been booked by the guest and confirmed by the hotel (in writing, by telephone, online or by e-mail).
The hotel is entitled to reject booking requests without stating reasons.

Booking Errors
Obvious errors, typographical, calculation and transmission errors, particularly with regard to prices, availability or services, remain reserved. The hotel shall inform the guest of such an error without undue delay. Any payments already made shall be refunded without undue delay in such case.

3. Prices & Additional Charges
All prices are stated in euros per room, studio or apartment and per night, including statutory VAT, unless expressly stated otherwise.
Local tax, overnight stay tax and other public charges in the applicable statutory amount are not included and shall be charged additionally.
The hotel reserves the right to change prices if statutory duties, fees or taxes change after conclusion of the contract, provided such changes are beyond the hotel’s control.

Local Tax, Overnight Stay Tax & Mobility Contribution
The local taxes, overnight stay taxes and other charges imposed by law or by the authorities of the Province of Salzburg or the competent municipality shall apply in their respectively valid amount. The amount of these charges is determined by the regulations applicable at the time of the stay. The specific overnight stay tax is determined by municipal ordinance.
Where provided by law, the charge includes a mobility contribution. In the Province of Salzburg, an official mobility contribution of EUR 0.50 per chargeable overnight stay applies in the initial phase, and EUR 1.10 from May 2027. According to the information provided by the Province of Salzburg, the Guest Mobility Ticket is issued at check-in at the accommodation.
These charges apply to guests aged 15 and over. Children aged 6 and over also receive the Guest Mobility Ticket free of charge.

4. Booking & Payment Terms

Booking
As a rule, bookings may only be made by persons of legal age. Minors may only be accommodated if accompanied by an adult guest or with the corresponding consent of their legal representative, provided that the hotel expressly agrees.
The hotel is entitled to request appropriate proof of age, identity and, where applicable, the consent of the legal representative upon arrival.

Deposit
The hotel is entitled to require a deposit or a credit card guarantee.
For standard bookings, the deposit amounts to 30% of the total price.
For early bird bookings, a deposit of 100% of the total price is required.
The remaining amount of the stay must be paid no later than upon departure, unless otherwise agreed.

Accepted methods of payment are:
• Cash
• EC/debit card
• Credit cards (e.g. Visa, Mastercard, AMEX)

Restriction on Combining Special Offers
Special offers, discount promotions and special booking deals may only be applied once per stay and guest. Multiple or consecutive use of the same or combinable promotions is excluded unless expressly agreed otherwise.

5. Check-in and Check-out
Rooms are available from 2:00 p.m. on the day of arrival; studios and apartments from 4:00 p.m.
The reservation will be held until 6:00 p.m. on the day of arrival. In the event of arrival after 6:00 p.m., the hotel requests timely notification by e-mail or telephone. On the day of departure, rooms must be vacated by 11:00 a.m., and studios and apartments by 10:00 a.m.
Late check-out is possible upon request, subject to availability and for an additional charge.
In the event of delayed departure, the hotel is entitled to charge an additional fee or an additional overnight stay.

6. Cancellation Policy
The following cancellation periods shall apply unless different terms have been agreed for the respective booking:

Cancellation Terms for Individual Bookings:

Standard (summer and winter low season)
up to 8 days before arrival: free of charge
7 to 4 days before arrival: 50% of the travel price
3 to 1 day before arrival and on the day of arrival: 90% of the travel price

Winter high season / Christmas / New Year’s Eve
up to 30 days before arrival: free of charge
29 to 14 days before arrival: 50% of the travel price
13 to 7 days before arrival: 70% of the travel price
6 to 1 day before arrival and on the day of arrival: 90% of the travel price

Early Bird
Early bird rates are special conditions and are therefore excluded from cancellations or free changes.

No-Show
In the event of no-show, the full stay will be charged.
The hotel recommends taking out travel cancellation insurance.

Cancellation Terms for Meetings & Events:

Group cancellation terms for individual rooms or persons:
Up to 5 cancelled rooms or persons:
up to 7 days before arrival: free of charge
from 7 days before arrival: 30% of the room price
from 3 days before arrival: 70% of the room price
from 1 day before arrival and in the event of no-show: 90% of the room price

Up to 10 cancelled rooms or persons:
21 days before arrival: free of charge
from 21 days before arrival: 30% of the room price
from 14 days before arrival: 70% of the room price
from 7 days before arrival and in the event of no-show: 90% of the room price

Up to 20 cancelled rooms or persons:
4 weeks before arrival: free of charge
from 28 days before arrival: 30% of the room price
from 21 days before arrival: 70% of the room price
from 14 days before arrival and in the event of no-show: 90% of the room price

More than 20 cancelled rooms or persons:
6 weeks before arrival: free of charge
from 42 days before arrival: 30% of the room price
from 28 days before arrival: 70% of the room price
from 21 days before arrival and in the event of no-show: 90% of the room price

In case of exclusive rental of the entire property and cancellation of the entire event:
6 months before arrival: free of charge
from 6 months before arrival: 50% of the total room price
from 3 months before arrival: 70% of the total room price
from 1 month before arrival: 90% of the total room price

Early Departure
In the event of early departure by the guest, there shall be no entitlement to a refund of services already booked and confirmed. The hotel is entitled to charge the agreed accommodation price insofar as the services not used could not be reallocated otherwise.

7. Withdrawal by the Hotel
The hotel is entitled to withdraw from the contract for good cause, in particular if:

  1. force majeure or other circumstances beyond the hotel’s control make performance of the contract impossible,
  2. rooms, studios or apartments were booked using misleading or incorrect information,
  3. the guest endangers or significantly disrupts hotel operations, other guests or employees

In such cases, claims for damages by the guest shall only exist within the framework of mandatory statutory provisions.

8. Use of Rooms, Studios and Apartments
The rooms, studios and apartments provided may only be used by the number of persons booked. The guest undertakes to treat the room, studio or apartment and its furnishings with due care.
The guest shall be liable for any damage caused in accordance with the statutory provisions.

9. Deposit / Security

Deposit
The hotel reserves the right to require a deposit:
• per hotel room: EUR 1,000.00
• per studio: EUR 2,000.00
• per apartment: EUR 3,000.00

The deposit shall be provided at check-in in cash or by credit card and shall be refunded or released at check-out following inspection of the accommodation, provided no damage is found.
If damage is identified, the hotel is entitled to retain the deposit in whole or in part until the amount of damage has been determined and to offset it against outstanding claims.

Cleaning Fee in Case of Extraordinary Soiling
The guest is obliged to leave the room, studio or apartment in proper condition. In the event of extraordinary soiling exceeding normal use, the hotel is entitled to charge an appropriate additional cleaning fee based on actual expenditure.

10. Force Majeure / Official Measures
The hotel shall not be liable for impossibility or delay in performance if this is due to force majeure, official measures, natural events, strikes, infrastructure failures or other circumstances beyond the hotel’s control.
In such cases, the hotel is entitled to withdraw from the contract in whole or in part, unless mandatory statutory provisions provide otherwise.

11. Pets
Pets are only permitted with the prior consent of the hotel.
An additional fee will be charged per pet and per night. The guest shall be liable for damage or soiling caused by pets.

12. Voucher Shop / Online Shop / Purchase of Vouchers and Products

Contracting Party
The purchase contract is concluded with Hotel Sendlhof Betriebsgesellschaft m.b.H.

Order and Delivery
Vouchers and items may be ordered via the online shop. Payment shall be made using the payment methods offered in the online shop.
Vouchers may be sent free of charge by e-mail or by post. The hotel shall only be liable for delays in postal delivery within the scope of mandatory statutory provisions.

Vouchers
Vouchers are provided with a unique code or barcode and may only be redeemed once.
The guest is responsible for the careful safekeeping of the voucher code. The hotel shall only be liable for misuse by third parties if the hotel is at fault.
The voucher shall only be valid after full payment has been made.
Cash redemption of vouchers is excluded unless mandatory statutory provisions provide otherwise.
If the value of a voucher is not used in full, the remaining value shall remain as credit unless otherwise lawfully stipulated on the voucher or in the product description.

Third-Party Vouchers
Vouchers purchased through third parties may only be redeemed within the framework of a binding booking and in accordance with the terms and conditions of the respective third-party provider.
Upon redemption of the voucher, its value shall be credited against the booked service. Statutory or contractual claims against the third-party provider shall remain unaffected.

Prices and Products
All stated prices are gross prices including statutory taxes and duties.
Where required, an invoice showing tax shall be issued in accordance with the applicable tax regulations.
Images of products may differ from the actual appearance. Errors and changes to the services offered remain reserved.
Should an ordered item no longer be available, an equivalent replacement may be offered after consultation, or the amount already paid may be refunded.

Validity of Vouchers
The validity period of service vouchers is stated on the respective voucher.
Value vouchers are subject to the statutory provisions. Under Austrian law, vouchers are generally redeemable for a long period; blanket short expiry periods are only permissible to a limited extent.

Right of Withdrawal / Cancellation
Consumers are subject to the statutory provisions governing the right of withdrawal for distance selling contracts. In the case of purchases of goods via the online shop, there is generally a 14-day right of withdrawal.
Statutory exceptions and restrictions apply to services.
There is no right of withdrawal if performance of the service has already begun within the withdrawal period.

Loss or Misuse of Vouchers
In the event of loss, theft or invalidation of vouchers, there shall be no entitlement to replacement unless the hotel is at fault.

Data Protection and Data Security
The transmission of sensitive data, in particular credit card data, is carried out via an encrypted SSL connection.
The data provided by the customer shall be processed exclusively for the handling of the order and customer support and shall not be passed on to unauthorized third parties unless there is a statutory obligation to do so.

Pricing Errors in the Shop
Obvious errors, typographical and calculation errors as well as technical transmission errors in the online shop, particularly regarding prices, product descriptions or availability, remain reserved. The hotel shall inform the guest of such an error without undue delay; payments already made shall be refunded without undue delay in such case.

Minimum Age
Purchases in the online shop are only permitted for persons who have reached the age of 18.

13. Rental Service / Equipment Hire
The hotel provides guests, subject to availability, with various rental items either free of charge or for a fee, such as strollers, running equipment, yoga equipment, bicycles and e-bikes.

The use of rental items is at the guest’s own risk. When using bicycles, the guest undertakes to comply with the applicable road traffic regulations.
The hotel shall not be liable for damage arising from the use of rental items unless caused intentionally or by gross negligence on the part of the hotel and unless mandatory statutory provisions provide otherwise.
The guest undertakes to treat the borrowed items with care and to return them in full and in proper condition after use.
The guest shall be liable for loss, damage or improper use of the rental items in accordance with the statutory provisions. The hotel is entitled to charge for any damage incurred or costs of replacement or repair accordingly.
There is no entitlement to the provision of specific rental items.

14. Use of Wellness, Fitness or Leisure Facilities
If the hotel provides wellness, fitness or other leisure facilities, their use shall be at the guest’s own risk.
The guest is obliged to comply with the applicable rules of use, safety instructions and opening hours.
Parents or other persons with custody or supervisory duties are responsible for supervising minors.

15. Parking Spaces / Underground Garage
The provision of a parking space or garage space does not constitute a safekeeping contract. The hotel shall therefore only be liable in accordance with the statutory provisions and not for damage, theft or other impairment to parked or maneuvered vehicles or to objects contained therein, unless caused intentionally or by gross negligence on the part of the hotel and unless mandatory statutory provisions provide otherwise.

16. Liability
The hotel shall be liable in accordance with the statutory provisions. Liability of the hotel for slight negligence is excluded to the extent permitted by law; this shall not apply to personal injury or in cases where mandatory consumer protection law provides otherwise.
The hotel shall only be liable for items brought in by the guest within the framework of the statutory provisions, in particular pursuant to Sections 970 et seq. of the Austrian Civil Code (ABGB).
Guests are advised to deposit valuables in the hotel safe.

17. Loss of Property / Lost and Found
Items left behind in the hotel shall only be handled in accordance with the statutory provisions. Return shipment shall only be made at the guest’s request and at the guest’s cost and risk.
The hotel is entitled to charge reasonable compensation for storage, packaging and shipping.

18. Technical Disruptions / Changes to Services
Temporary disruptions or failures of technical systems, in particular internet, Wi-Fi, heating, air conditioning, elevator, TV or wellness facilities, shall not give rise to any claim for damages or price reduction unless caused intentionally or by gross negligence on the part of the hotel and unless mandatory statutory provisions provide otherwise.

19. Data Protection
Personal data shall be processed in accordance with the provisions of the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act. Details can be found in our privacy policy on the website.

20. House Rules
The guest is obliged to comply with the hotel’s house rules.
In the event of serious violations, the hotel may terminate the accommodation contract without notice.

21. Place of Performance, Applicable Law and Jurisdiction
The place of performance is the registered office of the hotel.
Austrian law shall apply to the exclusion of the conflict of laws rules of private international law and the UN Convention on Contracts for the International Sale of Goods.
If the guest is an entrepreneur, the court with subject-matter jurisdiction at the registered office of the hotel shall have jurisdiction for all disputes arising from this contractual relationship.
For consumers, the statutory places of jurisdiction shall apply. A jurisdiction agreement with consumers shall only be valid to the extent permitted by law.

22. Final Provisions
Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
